Protecting your personal data is important to ODETTE LUNETTES and we comply with applicable laws and regulations, including the GDPR.

Below we clarify how we handle your personal data.  


1. Who is the data controller?

If you contact us because you want to exercise one of your rights (see point 7), please indicate clearly which right you want to exercise.  Please be as specific as possible when exercising your rights. 


2. What personal data do we process?


Depending on your capacity, we collect the following personal data: 

3. Why do we process the personal data (purposes)?

3.1 Execution of the agreement: creating and managing a personal account, correctly executing and complying with the agreement and/or agreements; communications related to the agreement, invoicing, customer service.

3.2 Purchases in the platform/webshop: the correct execution and observance of the agreement with regard to purchases on the platform/webshop; the processing of orders, returns and any after-sales services (such as deliveries and communications regarding orders and/or returns); checking your age in order to be able to verify whether you are of legal age to make online purchases invoicing, customer service.

3.3 Direct marketing: sending information about ODETTE LUNETTES, newsletters, offers and promotions. If you no longer wish to receive these communications you may opt out using the opt-out provided. Thereafter, you will no longer receive direct marketing from us about the communications you no longer want, and we will stop processing your personal data for these direct marketing purposes.

3.7 To comply with legal obligations (for example, in the context of anti-money laundering legislation and the fight against terrorism); 

3.8 General: you are not obliged to share your personal data with us, but if you do not communicate the requested personal data, we may not be able to provide you with the desired services and/or products.


4. Legal basis of the personal data?


The processing of ordinary personal data under 3.1 and 3.2 is based on the performance of the contract or to take action, at the request of the data subject, before the conclusion of the contract. 

The processing of particularly sensitive personal data of B2C Customers under section 3.1 as well as the personal data of potential B2C Customers under section 3.3 is based on the (explicit) consent of the data subject. 

The processing of personal data of B2B and B2C Customers and potential B2B Customers under section 3.3 as well as the processing of personal data under section 3.4, section 3.5 and 3.6 is based on the legitimate interest of our company (only and when the legitimate interest of our company outweighs the interest of the data subjects). The interests were further set out under sections 3.3 to 3.6. 

The processing of personal data under point 3.7 takes place in order to comply with legal obligations incumbent on our company. 


5. With whom do we share personal data? 


To third parties, we only provide relevant aspects of personal data, if these parties are contractually linked to ODETTE LUNETTES or act on behalf of or subcontract to ODETTE LUNETTES. Naturally, we have made agreements with these parties regarding the protection of your personal data. However, in the cases provided for by law, we are obliged to communicate certain personal data to the defined bodies.

We also do not provide personal data to companies outside the European Economic Area, unless there is an adequacy decision, standard provisions, appropriate safeguards, binding corporate rules or transfers referred to in Article 49 (1) GDPR.

In the event of a full or partial reorganization, merger, demerger, acquisition or sale of assets, we are entitled to transfer personal data to the relevant third party. 


6. How long do we keep personal data? 


We retain personal data only for as long as it is necessary for the exercise of the purposes defined above.  Since the retention period depends on the purpose, but also on the type of personal data, the retention periods vary. 


7. What rights do you have? 


Right of access, rectification or erasure

7.1.1. Right of access 
You have the right to access your personal data.  If you so request, we will provide you with a copy of the personal data processed.

7.1.2. Rectification
You have the right to have inaccurate or incomplete personal data corrected.

7.1.3. Deletion 
You have the right to ask ODETTE LUNETTES to delete your data in the cases provided for in Article 17(1) GDPR, such as if you withdraw your consent or if you object to processing for direct marketing purposes.

In that case, ODETTE LUNETTES shall delete your data without delay, unless that Article 17(3) GDPR applies.  For example, ODETTE LUNETTES will not have to delete your personal data if this is necessary in the context of complying with a legal obligation. 

7.2 Right to restrict a processing operation that concerns you 
You have the right to have the processing restricted in the cases provided for in Article 18(1) GDPR, e.g.: if the accuracy of the personal data is disputed. 

7.3 Right to data portability.
You have the right to request the personal data that you yourself have provided to ODETTE LUNETTES or to have it transferred to another company.

7.4 Right to withdraw consent 
You have the right to withdraw your consent at any time.  
Withdrawal of your consent shall not affect the lawfulness of the processing based on the consent, prior to its withdrawal

7.5 Right to lodge a complaint with supervisory authority 
If you do not agree with the position of ODETTE LUNETTES, if you would have comments on the exercise of your rights, or if you believe that the processing of your personal data would not be done in accordance with the legislation, including the GDPR, you may file a complaint with the competent supervisory authority for this purpose. 

7.6 Right to object to processing
You always have the right to object to processing for the purpose of direct marketing.  Practically, you can do this by the provided "opt-out". Then you will no longer receive direct marketing from us about the communication you no longer want, and we will stop processing your personal data for these direct marketing purposes.   

Of course it is possible that we still contact you if necessary in connection with the execution of the agreement. 
In addition, you also have the right to object at any time to processing based on Article 6, paragraph 1, (e) or (f) GDPR.  


8. Cookies


ODETTE LUNETTES also uses cookies on the website.  Cookies are small pieces of information stored by the browser on your computer that allow us to record certain information about the users of the website (e.g. choice of language, duration of your visit to the website, ...).  These data help us to better tune the website to your needs, preferences and ease of use.
